HPN Deputy Compliance Officer for China Operations


Duties and Responsibilities:


The qualified candidate will assist the Chief Compliance Officer in implementing compliance programs for HP Network’s business unit in China (H3C) and related ROW activities as a member of HP Networking Compliance Office. The individual will be responsible for day to day operations to provide consultative advice and support to H3C, to oversee H3C’s compliance programs and training, and its compliance to China laws and regulations. The role will facilitate and enhance business processes and trade activities for H3C, while pro-actively overseeing compliance in a rapidly changing regulatory environment. A majority of time will be involved in trade related compliance activities. Specific responsibilities include:


• Establish and manage a robust technology control plan for the H3C business which meets the complex goals of leveraging H3C innovation and R&D capabilities across the greater HP, maximizing revenue potential in the China market, and ensuring compliance with all applicable US and local trade regulations.


• Interface with H3C and HP R&D and Advanced Technology Groups to understand product development roadmap and technology/component sourcing to ensure ongoing compliance on cross collaboration project activities.


• Work with the Chief Compliance Officer to advise senior management on trade requirements for major initiatives and special projects (supply chain outsourcing, major investments, joint ventures, technology exchanges, offshore design centers, mergers and acquisitions).


• Communicate, across all HP business units, suppliers and customers, the policies and procedures to ensure compliance with all border crossing requirements into and out of H3C including technology transfers.


• Develop H3C’s import/export compliance policy statement and trainings/briefings of employees regarding all import/export regulations and H3C’s import/export policy.


• Work with outside consultants and H3C teams to provide updates to China’s certification requirements to ensure certification and remain compliant with Chinese regulations.


• Support H3C on managing China Regulatory Enforcement, Customs and other law enforcement inquiries, audits and investigations in China working in coordination with HP Global Trade and Legal teams


• Develop best practice process controls and seek process automation on Trade Compliance matters as appropriate.


• Work with the Chief Compliance Office on HP’s SBC and Anti-corruption program implementation and training for H3C.


• Support any audit and compliance review activities, such as Annual Compliance Wellness review, HP IA audit, Trade Audit, at H3C and provide assistance on any mitigation planning and program required to be put in place.


• Support any compliance related activities and program HP Networking Compliance Office group is doing, such as H3C expense reports review.


• Work with the Chief Compliance Officer to evaluate staffing and resource needs to effectively manage compliance responsibilities of the HPN Compliance office, including IT and audit resources.


• Work as team’s Records Coordinator to implement and manage HPN Compliance Office’s records in accordance to HP records management policy.


• Manage and support day to day HPN Compliance activities, including:


o Technology transfer reviews, both from to and from H3C, to ensure proper documentation is maintained and requests are processed within targeted timeframe.


o Review of requests to provide H3C personnel with HP account accesses


o Support H3C Trade Control team on any export control matter and escalation


o Support H3C’s RPL and NPS screening escalation requests and work with HP Global Trade as required.




o Conduct review of trade compliance related process as needed to ensure proper adherence to required regulations.




Qualifications

Skills and Experience:


• Experience in practical interpretation of international trade regulations including U.S. Export Administration Regulations (EAR), U.S. Customs & Border Protection regulations, and Treasury sanction programs.


• Strong working knowledge of the US export regulations (EAR) preferred.


• Familiarity with Chinese trade regulations such as encryption rules, CCCi Certification, Indigenous Innovation and Multi-Level protection Scheme preferred.


• Strong interpersonal skills, and good verbal, written and presentation skills are required.


• Fluency in Mandarin and English required


• Engineering background a plus


Qualifications and Education:


• Undergraduate degree required and extensive knowledge of US export regulations and Customs law preferred.


• 8+ years applicable experience in a corporate international business environment, with a minimum of 3 years strong management experience.


• Ability to make independent export-import related judgments and decisions and push the Compliance Office agenda


• Strong project management skills


• Ability to embrace change and respond quickly.


• Demonstrated ability to be a self-starter and self-managed.




• Positive attitude and strong work ethic.
